SECURED INVESTMENT CORP DOES NOT USE THE FRIENDS AND FAMILY PAGE TO PROVIDE FUNDING, we do not use the page to broker loans and do not endorse any funding providers, members, or contributors using this page. The Friends and Family Page does not constitute an offer or solicitation to lend. You understand your interactions on the Friends and Family Page do not constitute an offer, approval by us, or affiliate, of any loan or real estate investment. Secured Investment Corp does not lend or solicit to lend via the Friends and Family Page.
We do not collect private information on the Friends and Family Page, like social security, date of birth or banking information. DO NOT POST PRIVATE, PERSONALLY IDENTIFIABLE, OR SENSITIVE PERSONAL INFORMATION ON THE FRIENDS AND FAMILY PAGE.

Don’t mess with Friends and Family Page- Don’t try to interfere with the proper workings of the Friends and Family Page, bypass any measures, get unauthorized access in any way, impose an unreasonable load on us or third-party providers, access our source code or use a software or device to “crawl” any part of our website, bypass or interfere with stuff we put in place to secure the website.
Don’t send junk or spam- Don’t send unsolicited advertising or promotional material, or any junk mail, or spam. Don’t run mail lists or auto-responder of any kind on or through the Friends and Family Page.
Don’t use as a posting forum- Don’t post anything other than what pertains to your real estate deals. No posting questions or comments or separate interests. This is not a blog.
Don’t give private information- be suspicious of anyone asking for driver’s license, social security or bank account and report anyone asking for this information.
Don’t use for personal use- You agree and warrant that your use of the website is for business purposes only: not for personal, family or household purposes.
Don’t require any upfront payment- Don’t require any upfront fee of any kind prior to any real estate deal. No due diligence, broker, commitment, or application fees. All fees agreed to, should be taken out of loan proceeds at closing.
Don’t agree to, or pay anyone requesting an upfront payment before a transaction closes- We try our best to kick anyone off-site that requests private information or an upfront fee, but we generally depend on our community to report it, if and when it happens.
Third-Party Websites, advertisers or services, payment services and providers, comments, may contain links or user’s profile.
The Friends and Family Page may contain links to pages and content that are not owned, controlled or endorsed by Secured Investment Corp. You use at your own risk. We are not responsible for any damage or loss of any kind, if you follow a link or connect with anyone via our Friends and Family Page.
Your Content and Intellectual Property.
When you post information, you give us permission to use or duplicate it however we need in order to run the Friends and Family Page or show people what’s happening or feature it in our community. You are responsible for the content you post.
You give us permission to use your Content Non-exclusive, irrevocable, royalty-free, transferable rights to use and others acting on our behalf, worldwide. We can exercise, commercialize, and exploit all measures and means in the copyright, publicity, trademark, and database rights with respect to your Content

Obligations Concerning Confidential Information.

You agree that we, or one of our authorized third parties, may contact you, including through automated means, via telephone or mobile device, and/or SMS text messaging, even if your telephone number is listed on a Do-Not-Call registry. WARRANTIES. SECURED INVESTMENT CORP MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED CONCERNING OR RELATING TO THE FRIENDS AND FAMILY PAGE, ANY CONTENT POSTED ON EH PAGE, OR ANY OF THE USERS WHO ACCESS THE PAGE, INCLUDING, BUT NOT LIMITED TO: (A) NO WARRANTIES OF MERCHANTABILITY; (B) NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; AND (C) NO WARRANTY CONCERNING INTELLECTUAL PROPERTY RIGHTS.
LIMITATION OF LIABILITY. SECURED INVESTMENT CORP SHALL NOT BE LIABLE TO USER FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF BUSINESS OR OTHER ECONOMIC DAMAGE, OR INJURY TO PROPERTY. IN ADDITION, IN NO EVENT SHALL THE DAMAGES PAYABLE BY SIC TO USER OR ANY PERSON OR ENTITY CLAIMING THROUGH USER EXCEED $500.00. EACH PARTY ACKNOWLEDGES THAT: THIS SECTION REFLECTS AN INFORMED, VOLUNTARY ALLOCATION OF THE RISKS (KNOWN AND UNKNOWN) THAT MAY EXIST IN CONNECTION WITH THE ARRANGEMENTS SET FORTH IN THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, THE USE OF THE FRIENDS AND FAMILY PAGE AND STORAGE AND DISSEMINATION OF THE CONTENT; AND SUCH VOLUNTARY RISK ALLOCATION WAS A MATERIAL PART OF THE BARGAIN BETWEEN THE PARTIES; AND THE ECONOMIC AND OTHER TERMS OF THIS AGREEMENT WERE NEGOTIATED AND AGREED TO BY THE PARTIES IN RELIANCE ON SUCH VOLUNTARY RISK ALLOCATION.
Indemnification. User shall hold Secured Investment Corp and its shareholders, managers and employees, collectively and individually, harmless from and against any Losses arising out of or incurred as a result of or in connection with: (A) User’s material breach of this Agreement; or (B) a third party claim based on User’s: (1) use of the Friends and Family Page; or (2) Content.
Entire Agreement, Waiver and Modification. This Agreement sets forth the entire understanding of the parties concerning the subject matter of this Agreement and incorporates all prior negotiations and understandings. There are no covenants, promises, agreements, conditions or understandings, either oral or written, between them relating to the subject matter of this Agreement other than those set forth herein. No purported waiver by any party of any default by another party of any term or provision contained herein shall be deemed to be a waiver of such term or provision unless the waiver is in writing and signed by the waiving party. No such waiver shall in any event be deemed a waiver of any subsequent default under the same or any other term or provision contained herein.
Successors and Assignment. All of the provisions of this Agreement shall be binding upon and inure to the benefit of the parties hereto and, except as otherwise specifically provided in this Agreement, their respective permitted successors and assigns. No User may assign or delegate its, his or her, rights or obligations under this Agreement. Secured Investment Corp may assign and delegate its rights and obligations under this Agreement without notice to any User at any time and from time to time.
Captions. The captions and paragraph letters appearing in this Agreement are inserted only as a matter of convenience. They do not define, limit, construe or describe the scope or intent of the provisions of this Agreement.
Partial Invalidity. If any term or provisions of this Agreement, or the application thereof to any person or circumstance, shall be invalid or unenforceable, the remainder of this Agreement, or the application of such term or provision to persons or circumstances, other than those as to which it is held invalid, shall both be unaffected thereby and each term or provision of this Agreement shall be valid and be enforced to the fullest extent permitted by law.
Applicable Law and Venue and Forum. The provisions of this Section are a material part of the agreement of the parties. But for the provisions of the Section, Secured Investment Corp would not enter this Agreement, or provide any User with access to the Friends and Family Page. THIS AGREEMENT SHALL BE CONSTRUED AND GOVERNED UNDER AND BY THE LAWS OF THE STATE OF IDAHO FOR CONTRACTS EXECUTED AND TO BE PERFORMED IN IDAHO. EXCLUSIVE VENUE FOR ANY LEGAL ACTION AUTHORIZED HEREUNDER OR RELATING HERETO SHALL BE IN KOOTENAI COUNTY, IDAHO.
Third Party Beneficiaries. There are no intended, express or implied third-party beneficiaries to this Agreement.
WAIVER OF JURY TRIAL. THE PARTIES HEREBY KNOWINGLY AND VOLUNTARILY WAIVE ALL OF THEIR INDIVIDUAL AND COLLECTIVE RIGHTS TO A TRIAL BY JURY ON ANY AND ALL ISSUES PERTAINING TO OR ARISING OUT OF THIS AGREEMENT AND THE PRODUCTS.
Attorneys’ Fees. In the event any litigation, mediation, arbitration, or controversy between the parties hereto arises out of or relates to this Agreement or the Service, the Prevailing Party in such litigation, mediation, arbitration or controversy shall be entitled to recover from the other party all reasonable attorneys’ fees, expenses and suit costs, including any associated with any appellate proceedings and any post-judgment collection proceedings.
Content means any information uploaded or posted to the Friends and Family Page by User, including, without limitation, information about User or any real estate deal or mortgage offered by User.
